Web Hosting Terms

These Web Hosting Terms apply to all web hosting services provided by Infinity3 Ltd. These terms apply in addition to Infinity3 Ltd’s Standard Terms & Conditions. In the event of any conflict, these Web Hosting Terms take precedence in relation to web hosting services.
By purchasing or using web hosting services from Infinity3 Ltd, the Client confirms they have read, understood and agreed to these Web Hosting Terms.
1. SCOPE OF WEB HOSTING SERVICES
1.1 Web hosting refers to the provision of server resources used to store and deliver website content to visitors.
1.2 Hosting services include only what is explicitly stated in the selected hosting plan or proposal.
1.3 Web hosting does not include website design, development, content updates, security remediation, performance optimisation, or ongoing management unless explicitly stated or included via a Website Care Plan.
1.4 Hosting services are provided for lawful websites only.
2. HOSTING PLANS AND ACCESS
2.1 Hosting plans are offered as WordPress-focused hosting unless otherwise stated.
2.2 Infinity3 Ltd may limit the number of websites, domains, or environments hosted under a single plan as defined in the plan description.
2.3 Access to hosting accounts may be provided where applicable. Some managed hosting plans do not include direct control panel access by default.
2.4 The Client is responsible for keeping hosting access credentials secure.
3. FAIR USE AND RESOURCE LIMITS
3.1 Hosting services are provided on a fair use basis to ensure performance and stability for all clients.
3.2 Fair use applies to server resources including storage, bandwidth, processing, memory and database usage.
3.3 Infinity3 Ltd may impose reasonable limits to protect platform stability.
3.4 Where usage is excessive or impacts other users, Infinity3 Ltd may require the Client to upgrade, apply additional charges, restrict usage, or suspend the affected service until the issue is resolved.
4. ACCEPTABLE USE
4.1 The Client must not use hosting services for unlawful activities including distribution of malware, spam, phishing, hacking attempts, or copyright infringement.
4.2 Hosting services must not be used in a way that threatens server stability, security, or reputation.
4.3 Infinity3 Ltd reserves the right to suspend or terminate hosting services where misuse is identified.
5. BACKUPS AND DATA RESPONSIBILITY
5.1 Hosting plans may include automated backups as stated in the plan.
5.2 Backups are provided as a recovery aid and are not a guarantee against data loss.
5.3 The Client remains responsible for maintaining their own copies of critical data.
5.4 Infinity3 Ltd is not responsible for data loss caused by third party software, client actions, security incidents, or events beyond reasonable control.
6. SECURITY
6.1 Infinity3 Ltd takes reasonable measures to secure hosting environments.
6.2 No hosting environment can be guaranteed to be completely secure.
6.3 The Client is responsible for keeping their website software, passwords and credentials secure unless covered by a Website Care Plan.
6.4 Infinity3 Ltd is not responsible for security breaches caused by outdated software, weak passwords, or third party vulnerabilities outside its control.
7. UPTIME AND AVAILABILITY
7.1 Infinity3 Ltd will take reasonable steps to maintain reliable hosting availability.
7.2 Uptime is not guaranteed and may be affected by maintenance, updates, third party failures, or events beyond reasonable control.
7.3 Planned maintenance may result in temporary downtime.
8. EMAIL AND ASSOCIATED SERVICES
8.1 Hosting plans may include email services where stated.
8.2 Infinity3 Ltd does not guarantee email deliverability, inbox placement, or uninterrupted email service.
8.3 The Client is responsible for lawful use of email services including compliance with anti-spam regulations.
8.4 Excessive email sending may result in restrictions or suspension to protect service reputation.
9. THIRD PARTY SERVICES
9.1 Hosting services may rely on third party infrastructure, software, or providers.
9.2 Infinity3 Ltd is not responsible for outages, failures, or changes caused by third party services.
9.3 Third party terms may apply in addition to these Web Hosting Terms.
10. MIGRATIONS AND TRANSFERS
10.1 Where hosting migrations are offered, they are provided on a best-efforts basis.
10.2 Infinity3 Ltd does not guarantee compatibility of all websites, software, or configurations during migration.
10.3 The Client is responsible for verifying website functionality after migration unless covered by a Care Plan.
11. BILLING AND PAYMENT
11.1 Hosting services are billed on a recurring basis unless otherwise agreed.
11.2 Failure to pay hosting invoices may result in suspension or termination of hosting services in accordance with the Standard Terms & Conditions.
11.3 Suspension of hosting services may result in website downtime or inaccessibility. Infinity3 Ltd is not responsible for losses arising from such suspension.
12. CANCELLATION AND TERMINATION
12.1 Hosting services require thirty days written notice to cancel unless otherwise stated in the proposal.
12.2 Services remain active and billable during the notice period.
12.3 Upon cancellation or termination, the Client is responsible for migrating their website and data before the end of the service period.
12.4 Infinity3 Ltd may delete hosting data after a reasonable period following termination.
13. SUSPENSION AND REMOVAL
13.1 Infinity3 Ltd may suspend hosting services where:
(a) invoices remain unpaid,
(b) the Client breaches these terms, or
(c) hosting usage poses risk to infrastructure or other clients.
13.2 Suspension does not remove the Client’s obligation to pay outstanding fees.
13.3 Infinity3 Ltd is not responsible for losses caused by suspension or removal.
14. LIMITATION OF LIABILITY
14.1 Hosting services are provided on an “as available” basis.
14.2 Infinity3 Ltd is not liable for indirect or consequential losses including loss of revenue, loss of data, or business interruption.
14.3 Liability is limited in accordance with Infinity3 Ltd’s Standard Terms & Conditions.
15. GOVERNING LAW
15.1 These Web Hosting Terms are governed by the laws of England and Wales.
15.2 The courts of England and Wales have exclusive jurisdiction over any disputes arising from these terms.
