Website Care Plan Terms

These Website Care Plan Terms apply to all Website Care Plans provided by Infinity3 Ltd. These terms apply in addition to Infinity3 Ltd’s Standard Terms & Conditions. In the event of any conflict, these Website Care Plan Terms take precedence in relation to Website Care Plan services.

By purchasing or continuing to use a Website Care Plan, the Client confirms they have read, understood and agreed to these Website Care Plan Terms.

1. SCOPE OF WEBSITE CARE PLANS

1.1 A Website Care Plan is an ongoing service designed to maintain, monitor, support and manage a Client website.
1.2 Care Plans include only the services explicitly listed for the selected plan. Anything not listed is excluded unless otherwise agreed in writing.
1.3 Website Care Plans do not include website redesigns, major feature development, large content changes, or new functionality unless explicitly included or separately quoted.
1.4 Website Care Plans are not a substitute for a website project and do not include project-based work unless stated in the proposal.

2. CARE PLAN START DATE

2.1 Where a Website Care Plan is included in a proposal or purchased alongside other services, the Care Plan will commence on the date the proposal is accepted by the Client unless Infinity3 Ltd agrees a different start date in writing.
2.2 Billing begins from the Care Plan Start Date. This reflects onboarding, monitoring setup, configuration, licensing allocation and reserving ongoing support capacity.
2.3 Requests to delay the start of a Care Plan must be agreed in writing prior to proposal acceptance.

3. INCLUDED SUPPORT TIME

3.1 Each Website Care Plan includes a defined amount of support time per calendar month, as stated in the selected plan or proposal.
3.2 Support time may be used for maintenance tasks, updates, fixes, content changes, minor improvements, or assistance related to the website.
3.3 Unused support time does not roll over to future months.
3.4 Where the Client requires additional time beyond the plan allowance, this will be chargeable at Infinity3 Ltd’s prevailing hourly rate unless otherwise agreed.
3.5 References to unlimited small tasks mean that multiple small requests may be submitted, but all work is carried out within the plan’s included support time and must be reasonable in scope.

4. UPDATES AND MAINTENANCE

4.1 Website Care Plans may include management of WordPress core, theme and plugin updates as specified in the selected plan.
4.2 Updates are managed with reasonable care, however Infinity3 Ltd cannot guarantee that updates will not cause conflicts or issues due to third party software.
4.3 Where updates cause issues outside Infinity3 Ltd’s control, reasonable efforts will be made to resolve them within the scope of the Care Plan.
4.4 Some updates or fixes may require additional chargeable time where complexity or third party issues are involved.

5. MONITORING AND BACKUPS

5.1 Website Care Plans may include uptime monitoring, security monitoring and regular backups as specified in the plan.
5.2 Backups are intended as a recovery aid and are not a guarantee against data loss.
5.3 Infinity3 Ltd is not responsible for data loss caused by factors outside its reasonable control including third party failures, hacking, malware, or client actions.

6. HOSTING AND THIRD PARTY SERVICES

6.1 Website Care Plans may include managed hosting where stated in the plan or proposal.
6.2 Where hosting is included, Infinity3 Ltd may not provide direct hosting control panel access by default. Requests such as email setup or configuration changes may be handled by Infinity3 Ltd as part of the Care Plan.
6.3 Where the Client requires direct hosting access, a transfer to a separate hosting arrangement may be required.
6.4 Infinity3 Ltd is not responsible for failures or outages caused by third party hosting providers, software vendors, or external services.

7. CLIENT ACCESS AND THIRD PARTY CHANGES

7.1 The Client authorises Infinity3 Ltd to access the website, hosting environment and related systems as required to deliver the Care Plan.
7.2 If the Client or a third party makes changes that damage the website, affect performance, or cause errors, time spent diagnosing and repairing the site may be chargeable and may require removal or rollback of those changes.
7.3 Infinity3 Ltd cannot guarantee website stability where multiple parties have unrestricted access.

8. SECURITY AND MALWARE

8.1 Website Care Plans may include security monitoring and malware scanning as specified in the plan.
8.2 Infinity3 Ltd does not guarantee that a website will be free from security breaches, malware, or attacks.
8.3 Where malware removal or emergency response is included in the plan, it will be carried out within reasonable limits. Extensive remediation may require additional fees.

9. REPORTING AND COMMUNICATION

9.1 Website Care Plans may include periodic reports as specified in the plan.
9.2 Reports are informational and do not guarantee specific outcomes or improvements.
9.3 Communication regarding Care Plan work will be handled via agreed channels such as email or support systems.

10. FAIR USE AND SERVICE LIMITS

10.1 Website Care Plans are provided on a fair use basis to ensure service quality for all clients.
10.2 Excessive, unreasonable, or abusive use of support may require a plan upgrade, additional charges, or revised service terms.
10.3 Infinity3 Ltd reserves the right to define what constitutes reasonable use based on the selected plan.

11. CANCELLATION AND NOTICE

11.1 Website Care Plans are recurring services.
11.2 Unless otherwise stated in the proposal, cancellation requires thirty days written notice.
11.3 Services remain active and billable during the notice period.
11.4 Where discounted pricing, bundled services, or minimum terms apply, early cancellation may require payment of remaining fees as set out in the proposal.
11.5 No refunds are provided for partial months or unused support time.

12. SUSPENSION FOR NON-PAYMENT

12.1 Failure to pay invoices when due may result in suspension of Care Plan services in accordance with the Standard Terms & Conditions.
12.2 Infinity3 Ltd is not responsible for any loss or damage arising from suspension due to non-payment.
12.3 Suspension does not remove the Client’s obligation to pay outstanding fees.

13. TERMINATION BY INFINITY3 LTD

13.1 Infinity3 Ltd may terminate a Website Care Plan immediately where the Client breaches these terms, fails to pay invoices, engages in unlawful activity, or acts in a way that places unreasonable risk on Infinity3 Ltd.
13.2 Where Infinity3 Ltd terminates a Care Plan for reasons other than breach, a refund of any unused portion of the current billing period will be the maximum liability.

14. LIMITATION OF LIABILITY

14.1 Website Care Plans reduce risk but do not eliminate it.
14.2 Infinity3 Ltd is not liable for indirect or consequential losses including loss of revenue, loss of data, or business interruption.
14.3 Liability is limited in accordance with Infinity3 Ltd’s Standard Terms & Conditions.

15. GOVERNING LAW

15.1 These Website Care Plan Terms are governed by the laws of England and Wales.
15.2 The courts of England and Wales have exclusive jurisdiction over any disputes arising from these terms.
